Acceptance of these terms
These terms of use apply to xplabs.co.za (the "site"), operated by XP Labs Pty Ltd ("XP Labs", "the company"). By using the site, including the planning conversation, you agree to these terms. If you do not agree with them, please do not use the site.
About the site
The site presents XP Labs' approach to AI, automation, software and marketing systems for small and medium-sized businesses, and offers a planning conversation that diagnoses a likely growth constraint and produces a Growth Brief. The site is informational and diagnostic. It is not a binding proposal, quotation, or contract for any specific work, and using it does not create an engagement between you and XP Labs.
The planning conversation and Growth Brief
The planning conversation uses a structured set of questions to identify a likely constraint on your business's growth. The resulting Growth Brief is a starting point for a conversation with XP Labs, based only on what you choose to share. It does not constitute professional advice, a guarantee of results, or a complete analysis of your business, and should not be relied on as such without further discussion with XP Labs.
Acceptable use
When using the site, you agree not to:
- submit false information with intent to mislead;
- attempt to disrupt, overload, or gain unauthorised access to the site or its systems;
- use automated means to scrape or harvest content beyond normal, reasonable use; or
- use the site for any unlawful purpose.
Intellectual property
The site's design, the XP Labs name, logo and visual identity, the conversation system, and the written content on the site are the property of XP Labs or its licensors and are protected by copyright and other applicable laws. Nothing on the site grants you a licence to use XP Labs' branding or content beyond viewing it for your own reference, without prior written permission.
Third-party links and tools
The site may link to third-party resources or use third-party services (for example, analytics or email delivery). XP Labs is not responsible for the content, accuracy, or practices of third-party sites, and linking to them does not imply endorsement.
No warranty
The site, the planning conversation and the Growth Brief are provided "as is", without warranty of any kind, express or implied, including as to accuracy, completeness, or fitness for a particular purpose. The deterministic and, where enabled, AI-assisted conversation logic is designed to be useful, not infallible, and its output should be treated as a starting point, not a final answer.
Limitation of liability
To the fullest extent permitted by law, XP Labs will not be liable for any indirect, incidental, or consequential loss arising from your use of the site or reliance on a Growth Brief, including loss of revenue, business, or data. Nothing in these terms excludes liability that cannot lawfully be excluded under South African law.
Indemnity
You agree to indemnify XP Labs against any claim, loss or damage arising from your misuse of the site or your breach of these terms.
Governing law
These terms are governed by the laws of the Republic of South Africa, and any dispute arising from them falls under the jurisdiction of the South African courts.
Changes to these terms
These terms may be updated from time to time. Continued use of the site after a change constitutes acceptance of the updated terms. The "last updated" date at the top of this page reflects the most recent revision.
